Tarke Nihad Siam, 47, was initially apprehended in 2022 for illegal possession of firearms and assault. He was arrested by the National Bureau of Investigation (NBI) but was transferred to the custody of the BI after Interpol reported that he was wanted in Abu Dhabi for assault and alcohol abuse charges.

According to Siam's escorts, they brought the Jordanian to the Makati City Regional Trial Court Branch 237 on January 16, where he faced charges for violating the Comprehensive Law on Firearms and Ammunition. After the hearing ended at noon and as they were leaving the court, Siam asked permission to use the restroom.

He was allowed by the BI agent to go to the restroom while the agent stood guard at the door. When the BI agent noticed that Siam had been in the restroom for an extended period, he forced the door open and discovered that Siam had used a small window in the restroom to escape.

BI Commissioner Norman Tansingco ordered a manhunt for Siam's re-arrest. The two job order personnel who acted as guards for Siam have been dismissed from their duties, while the team leader, a regular employee of the BI, is also facing charges following the incident.
