Makati City Mayor Abby Binay filed an "Urgent Motion for Clarification with Prayer for the Issuance of a Status Quo Ante Order" at Branch 153 of the Taguig Regional Trial Court (RTC) on October 5.
The motion filed by Makati aims to maintain the status quo or revert the situation concerning the jurisdictional dispute between Makati and Taguig City over the barangays in EMBO (Enlisted Men's Barrios) and Fort Bonifacio. This comes in the wake of Taguig's alleged intent to implement the Supreme Court's decision in Civil Case Number 63896, despite the absence of a writ of execution from the trial court.
In her statement to the media, Binay said that Makati merely wants to ensure an orderly administration of the Supreme Court's decision to prevent confusion and delay in providing primary services to the affected areas.
The Makati city government stated that the Supreme Court did not clarify, nor was it part of their decision, whether the decision should be immediately implemented, and the exact jurisdiction of Parcels 3 and 4 of PSU - 2031, the subject of dispute between Taguig City and Makati City, was not specified.
As a result, Makati requested the Taguig Trial Court to clarify and confirm the necessity for the Taguig city government to first obtain a writ of execution, and the court's determination of the exact scope of the contested jurisdiction before implementing the Supreme Court's decision.
Makati also stated that the urgent motion could provide an opportunity to defend their rights as the owners of the buildings situated in the disputed territory.
Earlier, the Taguig city government stated that a writ of execution is not necessary as it is clear from the Supreme Court's decision that Parcels 3 and 4, which include the EMBO barangays and Fort Bonifacio, as well as Bonifacio Global City (BGC), belong to Taguig City.
