City councilors and members of Congress are both elected from legislative districts, so if EMBO barangay voters are allowed to vote for their councilors, they should also be allowed to vote for their congressional representative, according to Binay.

Binay also emphasized that the city councilors and members of Congress are both elected from legislative districts. Therefore, if Comelec allows EMBO residents to vote for their councilors, they should also have the right to vote for their congressional representative.
The Mayor further remarked that the city of Taguig must champion the right of EMBO residents to vote for their congressional representative.
On the other hand, Comelec Chairman George Garcia stated that it remains unclear which of the two districts of Taguig encompasses EMBO, especially since it does not appear in the list of any district of Taguig. Garcia believes that the matter needs to be legislated in Congress, either to decide which district encompasses the ten EMBO barangays or to create a third district in Taguig.

The EMBO Barangays were previously under the jurisdiction of Makati's second district where their congressman was Representative Luis Campos, Jr., the husband of Mayor Binay.

However, when the Supreme Court decided to transfer jurisdiction to Taguig, claiming that it is the rightful jurisdiction over the said barangays and Bonifacio Global City, the EMBO barangays were removed from Makati's second district.
The 10 EMBO barangays are as follows: Pembo, Comembo, Cembo, South Cembo, West Rembo, East Rembo, Pitogo, Rizal, Northside, and Southside.
